NEW YORK (CBSNewYork) Amid talk of reinstating the assault weapons ban that expired eight years ago, police departments nationwide are thinking of ways to confiscate such weapons.
As WCBS 880's Marla Diamond reported, among the departments considering taking action is the NYPD. Police Commissioner Ray Kelly said if Congress were to reinstate the ban, police are wondering whether it will be their responsibility to confiscate them.

I think that is a big, big question Kelly said. ¡°Do you engage in a buyback?
Kelly said the NYPDs existing gun buyback has been successful.
¡°We¡¯re up to about in two years, about 8500 weapons now, and that¡¯s a significant number,¡± Kelly said.
But Kelly said with hundreds of millions of guns out there, buybacks are just one small part of curbing gun violence.
President Barack Obama and other lawmakers have come out in favor of re-implementing the assault weapons ban, as well as limits on the size of clips that can be used.
Here is where we see if the street cop understands HE will be the next target and disobey any order to confiscate weapons.
This is the scenario long sought by the liberals.
An order to confiscate weapons occurs. Local police departments refuse to enforce the law. Posse Comiitatus is changed to use the military to enforce the law. Wholesale mutiny occurs at military sites across the nation as troops refuse to obey orders. As chaos reigns in the country and small armed riots occur, with liberal politicians being dragged into the streets and shot, the President in desperation to maintain order and implement the law, appeals to the UN for help. The UN votes unanimously to send troops to quell the violence and enforce an illegal law. The President declares martial law and suspends Habeus Corpus, detains the most outspoken opponents in Congress and 'cancels' the next election. The President declares the Constitution suspended. Even his supporters are moved to re-education FEMA camps. Mutinous US military units begin to desert their posts with weaponry, attacking the invading foreign troops. Political opposition creates a 'government-in-exile' in the Western states based on the original Constitution. The UN commander, who has been given unlimited powers now starts to bomb civilian enclaves. Summary execution of all opposition begins. Anyone speaking out is shot. Millions of Chinese troops move in from the coast, like a harvesting machine, occupying towns, rooting out small bands, killing on a wholesale basis.
