Jodi Arias: Cold-blooded killer or innocent victim? Jodi Arias is accused of shooting her ex-boyfriend in the face, stabbing him 29 times and slitting his throat from ear to ear. At her trial in January, her attorneys will argue she killed him in self-defense. CLICK
I am watching this on In Session this week.
What bothers me is that domestic violence is even allowed to be an issue here. They didn't live together. Her defense is self defense, but they keep tossing in domestic violence.
Remember when the Menendez brothers killed their parents? At the time I remembered thinking, "Why didn't they just leave? They were adults. They could have gotten on a bus and moved to Maine."
I think defense attorneys try their best to get their clients off, no matter what. This doesn't always mean that their clients are innocent.
Orthodoxy SUCKS.

Our Court System is not about justice, fairness or common sense - its about evidence that can be admitted to court, skill of the lawyers and judicial bias.
A case law study involved a murder where a couple of cops heard a lady calling for help from an apartment so they broke in and found a woman beaten and tied up in the bedroom. They then looked around, opened the door to the bedroom closet and found a dead Nun who had been dismembered. They caught the guy and took him to trial. He admitted he murdered the Nun etc. The Court, however, tossed out his confession and all all evidence of the murdered Nun because the cops did not have a search warrant.
In a trials the most important factor to winning is the jury selected, followed by the evidence you can get in for the jury to see and at a far distant last is the facts of the case.
Outside judicial bias I don't think the system is wrong. Defense attny's goal most of the time is to win the "game" according to the rules in the law. Innocent or not, that's the system
My gripe in this case is imo the misuse of domestic violence in the court of public opinion. Defense lawyers can and do put forth crap and in this case that's what they are doing...it worked for the Anthony. Juries can be stupid and this just bugs me

Over time I don't know that I would want to put my trust in juries. Look at the education system. Do you think everyone on a jury has the same critical thinking skills necessary to examine the evidence equally and accurately? That worries me.

Let's see. As a former prosecutor, I'd ask two questions. Was it the shooting, the 29 stab wounds or the thoat slitting that constituted the self defense. And if the defendant was so afraid of a [presumably] live perp, why get close enough to slit his throat and stab him 29 times, when the gun allows her to defend herself from a safe distance? Just sayin'.

Years ago, the next county over, a defense attorney got the little woman off of a murder charge on 'battered wife syndrome' in a case where she hired a hit man to whack the husband. One of the lady jurors said, in sum and substance, "Let that be a warning to all the husbands out there". What it warned me was that if things weren't going well, whack her first.
I am not sure of her guilt or innocence, that old presumption thing you understand, but after having read all she did to this guy, I felt fairly certain in concluding she was a mite upset.
"Arias gave three different accounts of her whereabouts. She originally told police that she had not been in the home at the time of Alexander's death.
She later told police that two intruders had broken into Alexander's home and that they murdered him and attacked her. Finally, she stated that she killed Alexander in self-defense and was a victim of domestic violence.
It was during this interview that she offered up her second version of events by describing how two unknown individuals attacked her and Alexander. She was "miraculously" spared after the assailants gun misfired which gave her time to flee the home, naked, but she did not make any attempts to get help for wounded Alexander."
She has an 8th grade education and she thinks the dog ate my homework is going to work in the grownups world.
