Legislation that would award the injured from the 2009 Fort Hood shooting the Purple Heart would adversely affect the trial of Maj. Nidal Hasan by labeling the attack terrorism, according to a Defense Department document obtained by Fox News. ------ A source with knowledge of the position paper told Fox News that DOD is putting on a full-court press by sending senior officials, including generals, to meet with lawmakers in an effort to block support.
But Neal Sher, counsel for the Fort Hood families involved in a federal lawsuit against the department, told Fox News that the document -- an "official Army response" to the request for Purple Heart status -- is "an utter outrage" and that it was not surprising given it comes from the same department which labeled the attack "workplace violence." ------ The Defense Department document says that to expand the Purple Heart criteria to include “domestic criminal acts or domestic terror attacks would be a dramatic departure” from traditional criteria. ------ While the document claims "the Government has vigilantly tended to the needs of the victims and families since the tragic events of November, 5 2009," Sher said the facts show the Army has failed to live up to its creed that no soldier will be left behind.
I sure would like to hear from some of the survivors. The news media would normally be interviewing survivors and family of those who had died. Just a big silence for all of these people. Disgusting.

This is a good reason why I get so upset with Congress. Even though democrats have a senate majority, both branches should insist on media attention for the wrongs these survivors have suffered. The republicans need to go after our Justice Department for writing their own rules and getting away with it. At the least, they could bring it before the public in a big way.

Up to a point, the Defense Department is correct. Purple Hearts are given to those killed or wounded in action against "the enemy" and not because your fellow Army comrade kills you for reasons unrelated to "the enemy".
Beyond that, before the trial, Maj. Nidal Hasan is still "innocent until proven guilty" and, theoretically, no criminal act at all may have been commited since Hasan could be proven at trial to have been insane or maybe it will be proven that his unknow twin brother did it ..... theoretically.
Giving out Purple Hearts, right now, officially proclaims Maj. Hasan to be guilty of treason before he has even had his trial. Legally, that is definitely "not Kosher".
So far, so good.
However, after the trial, after Maj. Nidal Hasan has been proven to be in direct contact with the enemy and acting on behalf of the war aims of a foreign entity, then Maj. Nidal Hasan becomes the equivalent of an illegal (for wearing a U.S. uniform at the time) combatant against the United States. Therefore, those killed would be eligible for Purple Hearts as Maj. Nidal Hasan was as much the "enemy" as when Benedict Arnold attacked Virginia after the West Point plot failed and Arnold switched sides. Arnold's 1780-81 attacks upon Virginia were not " “domestic criminal acts". They were "enemy action".
The matter will boil down to whether the Obama Administration will pursue the matter that Hasan was in contact with the enemy and acting as an enemy agent or whether the Obama Administration will sweep that under the rug for the sake of Political Correctness.
My bet is that the Obama Administration will push for a cover up.

Exactly! Trying to bring this POS to trial had been delayed for years. Some of it because he won't shave! Our justice system is geared to protect the criminal instead of the victim!
