A judge on Monday invalidated New York City's plan to ban large sugary drinks from restaurants and other eateries, one day before the new law was to take effect.

The city is "enjoined and permanently restrained from implementing or enforcing the new regulations," New York Supreme Court Judge Milton Tingling decided Monday.

The regulations are "fraught with arbitrary and capricious consequences," the judge wrote. "The simple reading of the rule leads to the earlier acknowledged uneven enforcement even within a particular city block, much less the city as a whole….the loopholes in this rule effectively defeat the state purpose of the rule."

Beginning March 12, the city was set to prohibit restaurants, mobile food carts, delis and concessions at movie theaters, stadiums and arenas from selling sugary drinks in cups or containers larger than 16 ounces. Fines assessed against sellers for violations of the rules would have been enforced starting in mid-June.

The city rules didn't include convenience stores, such as 7-Elevens, and supermarkets, both of which are regulated by the state government. "

What i have never understood is how an educated man though he could do this stuff, bitchburg is a loon.

Ya know..I smoke. And when this all began, it started with smoking. All of the non-smokers couldnt see past the ends of their noses. Ooooh..no more smelly smoke. Didnt they see, this was just the beginning?

Next was transfats, and mandatory menus with calorie content. And salt. Now soda...whats next? Booze? Donuts? Steak? Consumed in large quantities..nothing is good for you.

It is not the job of the government to decide what you eat or drink. And..it isnt all the fault of the food. Most dont get enough exercise, especially children. But, we live in a different world now, than when I was a kid. Your mother could let you outside..roam the streets even..and you were safe. Now...both parents work. Your kids arent even safe walking to the school bus..the only place you know they are safe is inside.

Yet..do people see what their government, on all levels are trying to do? Control. They are so busy worried about smelling smoke and fat people..that they dont see the real issue.

Actually, No. The City immediately appealed the ruling, so the law/reg stays in force during the appeals process.
