WASHINGTON—President Barack Obama plans to nominate James Comey to lead the Federal Bureau of Investigation, three people familiar with the decision said Wednesday, choosing a former Bush administration official best known for a 2004 standoff with his bosses over a secret surveillance program.
Mr. Comey, 52 years old, would succeed Robert Mueller, who is set to step down as FBI director in September after 12 years on the job. The White House had narrowed the search to Mr. Comey and Lisa Monaco, the White House's senior counterterrorism official who formerly served in the Obama Justice Department.
Nominating Mr. Comey, a Republican, could help get the pick through the Senate, where GOP senators have blocked several nominees with strong Democratic ties. A White House official said no final decision on the FBI head has been made and declined to comment further.
Mr. Comey earned some Democratic praise for the famous 2004 clash in a hospital room when he was acting attorney general. White House officials wanted then-Attorney General John Ashcroft, who was hospitalized, to sign off on a plan to wiretap Americans' phone calls without warrants. Mr. Comey resisted approving the plan and said he threatened to resign. At that point, President George W. Bush agreed to make changes to the program.
"Some Republicans think of me as a Democrat and Democrats think of me as a Republican," Mr. Comey said last year.

They don't need anything on him because they don't care about the FBI. They control the the Justice Dept and that is apparently enough to keep them above the law. Otherwise people would be going to jail as we speak.
